These Terms & Conditions ("Terms") govern the use of the invoicing and payout platform operated by Fustle ehf (kt. 630626-0640), Iceland ("Fustle", "we", "us").

By creating an account or using any part of the Service, you accept these Terms and enter into a legally binding contract with Fustle.

If you do not agree, do not use the Service.


1. Definitions

  • Service — the platform and related features through which independent workers create invoices, collect payments, and, where selected, use payroll processing.
  • User / you — any natural person (≥ 18 years old) who registers an account with a valid Icelandic electronic ID (rafræn skilríki) to invoice through Fustle.
  • Client — any entity that you invoice through the Service.
  • Invoicing — the service in which you are the seller and invoice issuer, Fustle forms the invoice and collects the payment as payment agent, and you remain responsible for taxes and filings.
  • Laun — the payroll-intermediary service in which Fustle invoices the Client, receives the funds, processes the deductions and employer charges included in the service, and pays your net remuneration. Fustle does not become your employer.
  • Payout — funds remitted to you after the deductions applicable to your selected service.
  • Advance Pay — an optional feature allowing early payout before the Client has settled the invoice.

2. Eligibility & Registration

  1. You must be at least 18 years old, hold an Icelandic kennitala, and authenticate with electronic ID.
  2. You warrant that all registration data (name, address, bank IBAN, pension‑fund choice) is accurate and kept up to date.
  3. Each User may hold one active account. We may suspend duplicate or incomplete accounts.

3. Scope of the Service

  1. Under Invoicing, you are the seller and invoice issuer. Fustle prepares the invoice on your behalf, collects the Client's payment as payment agent, deducts the published service fee, and remits the balance to you.
  2. Under Laun, Fustle acts as a payroll intermediary, invoices the Client, receives the funds, processes the statutory deductions and employer charges included in the service, and pays your net remuneration.
  3. Fustle is not your employer and does not provide accident or liability insurance. You remain an independent contractor responsible for your own insurance cover.
  4. We do not give legal, tax, or financial advice. Consult a professional for your specific situation.

4. Fees & Payouts

  1. Service fee: as published on our website at the time of invoicing, subject to applicable VAT (vsk). The fee is deducted automatically before payout.
  2. Advance Pay fee: displayed in‑app before confirmation and deducted from the early payout.
  3. When cleared funds appear in Fustle's account during banking hours, we usually forward the payout on the same day by Direct SEPA. The receiving bank's processing may affect the arrival time.
  4. Where a Client-specific schedule applies, work from the 1st–15th is scheduled for the 25th and work from the 16th–month-end for the 10th of the following month. A date falling on a weekend or public holiday moves to the next banking day unless paid earlier.
  5. Bank charges, FX spreads, or returned‑payment fees imposed by your bank are your responsibility.

5. Taxes, Social Charges & Pension

  1. Under Laun, we calculate and process Icelandic income-tax withholding, tryggingagjald (social security), endurhæfingarsjóður, and pension (15.5 % = 11.5 % employer + 4 % employee) based on rates in force on the payout date.
  2. You authorise Fustle to remit these amounts to Skatturinn and your nominated pension fund.
  3. Under Invoicing, you remain responsible for tax, VAT registration and returns, pension, social charges, and all filings. In all cases, you are responsible for monitoring obligations that fall outside the selected service.
  4. You are responsible for completing your annual tax return; we provide payslips and income statements for that purpose.

6. User Obligations

  1. Provide accurate work data (hours, deliveries, expenses). False, misleading, or fraudulent entries are grounds for immediate termination and potential legal action.
  2. Maintain valid bank details and contact information.
  3. Comply with all applicable laws, Client policies, and these Terms.
  4. Inform us by the 10th of the month if you intend to switch to self‑invoicing or another service (see § 12).

7. Prohibited Uses

You must not:

  • Use the Service for activities that are illegal, harmful, misleading, or violate Client terms.
  • Attempt to bypass the Service fee or manipulate invoiced amounts.
  • Reverse‑engineer, decompile, or interfere with platform security.

8. Advance Pay & Credit Risk

  1. Advance Pay is discretionary; we may decline without reason.
  2. If the Client fails to pay, you remain liable to repay the advanced amount upon our written request.
  3. We may offset any such debt against future payouts.

9. Intellectual Property

All software, trademarks, and content on the platform remain the property of Fustle or its licensors. You receive a non‑exclusive, non‑transferable licence to use the Service for legitimate invoicing.


10. Personal Data & Privacy

Processing of personal data is governed by our Privacy Policy, which forms part of these Terms.


11. Third‑Party Services and Clients

Your relationship with any Client or work platform is separate from Fustle. Fustle is not part of a Client's corporate group and is not liable for the Client's acts or omissions.


12. Term & Termination

  1. These Terms remain in force until your account is closed.
  2. User termination: email thjonusta@fustle.is with subject "Transfer to Self‑Invoicing" at least 15 calendar days before the switch date. Pending invoices and tax obligations must be settled first.
  3. Fustle termination: we may suspend or close your account immediately for breach, fraud, or legal risk. We will provide notice unless prohibited by law.
  4. Sections 9–16 survive termination.

13. Warranties & Liability

  1. The Service is provided "as is". We do not guarantee uninterrupted availability.
  2. To the maximum extent allowed by law, our liability is limited to the total Service fees you paid in the preceding 12 months.
  3. We are not liable for indirect or consequential losses, lost profits, or third‑party claims.

14. Indemnity

You will indemnify Fustle against any loss, claim, or penalty arising from your breach of these Terms or violation of applicable law.


15. Force Majeure

Neither party is liable for delay or failure caused by events beyond reasonable control (e.g., natural disasters, internet outages, government acts).


16. Changes to Terms

We may modify these Terms by posting an updated version 14 days before it becomes effective. Continued use after the effective date constitutes acceptance. Material fee changes require explicit email notice.


17. Governing Law & Dispute Resolution

These Terms are governed by Icelandic law. Any dispute shall be submitted to the exclusive jurisdiction of the District Court of Reykjavík (Héraðsdómur Reykjavíkur), unless mandatory consumer law grants you the right to sue elsewhere.
